1. Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of cmmcreadynow.com (the "Site") and any related information, tools, and services offered by CMMC Ready Now ("CMMC Ready Now," "we," "us," or "our"). By accessing the Site or requesting information through it, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Engagements for professional services are governed by a separately signed agreement, statement of work, or order form. Where those documents conflict with these Terms, the signed agreement controls for the scope of the engagement.

2. About Our Services

CMMC Ready Now provides CMMC 2.0 readiness, gap assessments, policy and procedure development, remediation support, and managed compliance services for defense contractors and other organizations in the defense industrial base. The Site provides general information about these services, resources, and points of contact.

Content on the Site is informational only. It is not legal advice, audit opinion, certification, or a guarantee of compliance outcomes. CMMC Ready Now is not a Certified Third Party Assessor Organization (C3PAO). Formal CMMC assessments must be performed by an authorized C3PAO. We help you prepare for those assessments.

3. Eligibility

The Site and our services are intended for businesses and professionals. By using the Site, you represent that you are at least 18 years old and that you have the authority to act on behalf of any organization you purport to represent.

4. Acceptable Use

You agree not to:

• Use the Site in any way that violates applicable law or regulation, including U.S. export controls.
• Attempt to gain unauthorized access to the Site, accounts, systems, or networks connected to the Site.
• Interfere with or disrupt the Site, its security, or its availability.
• Scrape, harvest, or extract data from the Site other than through ordinary browser use.
• Upload or transmit malware, exploit code, or other harmful content.
• Use the Site or our services to transmit Controlled Unclassified Information, classified information, or export-controlled technical data unless expressly authorized under a signed engagement with appropriate safeguards.

5. Consultations and Quotes

Requesting a consultation or quote through the Site does not create a services engagement. An engagement is formed only when a written agreement, statement of work, or order form is signed by both parties. Estimates, pricing, and timelines provided on the Site or in preliminary discussions are non-binding until documented in a signed agreement.

6. Intellectual Property

The Site, including its design, text, graphics, logos, and all underlying technology, is owned by CMMC Ready Now or its licensors and is protected by U.S. and international intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your internal business evaluation of our services. All other rights are reserved.

Deliverables created under a signed engagement are governed by the intellectual property terms of that engagement. Nothing on the Site transfers ownership of any deliverable absent a signed agreement.

7. User Submissions

If you submit feedback, suggestions, or ideas about the Site or our services, you grant CMMC Ready Now a worldwide, royalty-free, perpetual, irrevocable license to use and act on that feedback without obligation to you. Do not submit information through the Site that is confidential, proprietary, export-controlled, or otherwise sensitive. Sensitive information should be exchanged only through channels designated in your signed engagement.

8. Third-Party Links and Services

The Site may link to third-party websites, tools, or resources. We do not control those third parties, do not endorse them, and are not responsible for their content, products, or practices. Your use of third-party sites and services is at your own risk and governed by their own terms and privacy policies.

9. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CMMC READY NOW DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR FREE, OR SECURE, OR THAT CONTENT IS ACCURATE OR CURRENT.

NOTHING ON THE SITE GUARANTEES A PARTICULAR COMPLIANCE OUTCOME, CERTIFICATION RESULT, OR ASSESSMENT SCORE. COMPLIANCE DEPENDS ON YOUR ORGANIZATION’S IMPLEMENTATION, OPERATIONS, AND THIRD-PARTY ASSESSOR DECISIONS THAT ARE OUTSIDE OUR CONTROL.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CMMC READY NOW AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). LIABILITY UNDER A SIGNED SERVICES AGREEMENT IS GOVERNED BY THAT AGREEMENT.

11. Indemnification

You agree to defend, indemnify, and hold harmless CMMC Ready Now and its officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any third-party right.

12. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of or relating to these Terms or the Site is the state or federal courts located in Loudoun County, Virginia, and you consent to personal jurisdiction in those courts. Nothing in this section limits either party’s right to seek injunctive relief for intellectual property or confidentiality violations.

13. Changes to the Site or Terms

We may modify the Site or these Terms at any time. Updated Terms will be posted with a new effective date. Material changes will be highlighted where reasonable. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

14. Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice. Sections of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.
